Not everybody must apply for settled or pre-settled status by 30 June 2021
The deadline for submitting an application under Appendix EU for indefinite leave to enter or remain in the UK (“settled status”) or for limited leave to enter or remain (“pre-settled status”) may be 30 June 2021 or not, depending on your circumstances.
The application must be submitted by 30 June 2021 if you are an EEA citizen (or a close family member of such an EEA citizen) and you were resident in the UK for a continuous qualifying period which began before 31 December 2020.
Example
Robert is a Czech national resident in the UK since September 2018. He must apply by 30 June 2021.
Olena is Robert’s wife. She is an Ukrainian national, therefore non-EEA. She joined Robert in the UK in 2019. She must apply by 30 June 2021.
But the deadline of your application is not 30 June 2021 if you are a “joining” family member of such an EEA citizen and you joined that EEA citizen in the UK on or after 1 April 2021. In this case, you must apply for settled or pre-settled status within 3 months of the date you arrived in the UK, even if you arrived well after 1 July 2021.
Example
Linda is a German national resident in the UK since June 2017. Klaus is her husband. He is a German national and joined Linda in the UK on 15 August 2021. He entered the UK with a EUSS Family Permit which is valid from 15 July 2021 until 15 January 2022. Klaus must apply for pre-settled status by 15 November 2021 if he wants to remain in the UK after the expiry date of his EUSS Family Permit. Therefore, the deadline for Klaus’ application is not 30 June 2021, but 15 November 2021, three months after his arrival in the UK.
What about a child born in the UK after 1 January 2021? The child is a “joining” family member of his parent(s), as he was not resident in the UK before 31 December 2020. He must apply for settled or pre-settled status by 30 June 2021, unless he is born after 1 April 2021, in which case the application must be submitted within 3 months of the date on which the child was born in the UK.
Example
Raisa is born in the UK on 17 July 2021. Her father is an EEA citizen resident in the UK since October 2019, who has been granted pre-settled status in September 2020. An application for pre-settled status on behalf of Raisa must be submitted by 17 October 2021, within 3 months of the date on which Raisa was born in the UK.
